Foreign companies may set up business in India in any one of the following manners while retaining its status as a foreign company:
1. Liaison Offices – A foreign company can open a liaison office in India to look after its Indian operations, to promote its business interests, to spread awareness of the company’s products and to explore further opportunities. Liaison offices are not allowed to carry on any business or earn any income in India and all expenses are to be borne by remittances from abroad.
2. Project Offices – The project office is the ideal method for companies to establish a business presence in India, if the object is to have a presence for a limited period of time. It is essentially a branch office set up with the limited purpose for executing a specific project. Foreign companies engaged in turnkey construction or installation normally set up a project office for their operations in India.
3. Branch Offices – Foreign companies engaged in manufacturing and trading activities outside India may open branch offices for the purpose of:

a. Representing the parent company or other foreign companies in various matters in India, like acting as buying and selling agents.
b. Conducting research, in which the parent company is engaged, provided the results of this research are made available to Indian companies
c. Undertaking export and import trading activities.
d. Promoting technical and financial collaborations between Indian and foreign companies.

4. Trading companies Foreign companies may invest in trading companies engaged primarily in exports. Such trading companies are treated at par with domestic trading companies in accordance with the trade policy.
The RBI accords automatic approval for foreign equity up to 51 per cent for setting up trading companies engaged primarily in exports. All other proposals, which do not meet the criteria for automatic approval, can be addressed to the Foreign Investment Promotion Board, i.e. “FIPB”.
5. Wholly owned subsidiaries Foreign companies may set up a wholly owned subsidiary, which is an Indian Company with an independent legal status, distinct from the parent foreign company.
Under the current foreign investment policy, a wholly owned subsidiary can be established either under the automatic route, if the conditions specified therein are complied with (specific high priority industries) or obtain an approval from the FIPB.
6. Joint venture companies Foreign companies may set up a joint venture company i.e. in financial collaboration with an Indian business house/company in India, which is an Indian Company with an independent legal status, distinct from the parent foreign company.
Under the current foreign investment policy, a joint venture can be established either under the automatic route, if the conditions specified therein are complied with or obtain an approval from the FIPB.
Foreign companies intending to set up any kind of office mentioned above activities on behalf of the parent company or foreign trading companies in India for promotion of exports from India have to obtain a prior approval of the Reserve Bank by submitting an application in the prescribed form to the Central Office of Reserve Bank. On approval of such cases, permission is granted initially for a period of 3 years, subject to the condition that expenses of such office will be met exclusively out of inward remittances; such offices are not permitted to generate any income in India.

The BIS (Bureau of Indian Standards) Standard Mark (ISI Mark) is a quality mark. It gives the confidence to the customer and generally the organized purchase prefers products with ISI Mark. BIS carries out enforcement activity to curb the misuse of standard mark or its imitation by unscrupulous traders and manufacturers not holding valid BIS license.   Such action also helps consumers from being misled about quality of products that are marked with the BIS Standard Mark. Enforcement raids, which include search and seizure operations are carried out against traders and manufacturers on the basis of intelligence collected regarding misuse of the Standard Mark and where required, prosecution cases are filed in court of law.



STANDARD MARK

Licences to use the standard Mark, the familiar Mark, on large number of products are granted to manufacturers under the Certification Mark Scheme operated under the provisions of the Bureau of Indian Standards Act, 1986. The Standard Mark for every product is unique and is notified in the Gazette of India.

LICENCE NUMBER
Licence number (a seven digit number, represented as CM/L --------) is also given along with the Standard Mark. This helps in identifying the unit which has manufactured the product at a specific location.

WHAT DOES IT CONVEY?
Conveys that the product carrying the Mark conforms to the relevant Indian Standard certified by BIS.


Product Certification
The Product Certification Scheme of BIS aims at providing Third Party Guarantee of quality, safety and reliability of products to the customer. Presence of ISI certification mark, known as Standard Mark, on a product is an assurance of conformity to the specifications. The conformity is ensured by regular surveillance of the licensee's performance by surprise inspections and testing of samples, drawn both from the market and factory. The manufacturer is permitted to self certify the licensed products after ascertaining its conformity to the Standard. Through its surveillance operations, the Bureau maintains a close vigil on the quality of certified goods.
Management Systems Certification Scheme (MSCS)
·         Bureau of Indian Standards has been operating Management Systems Certification Scheme since 1991 under BIS Act, 1986 and Rules & Regulations framed there under.
·         Initially, BIS started the scheme with Quality Management System Certification (IS/ISO 9001) and over the years it has gradually expanded its activities to various other Management Systems.
·         NABCB, QCI has accredited Quality Management System Certification Schemes and Environmental Management System Certification Schemes of BIS.
·         The Management Systems Certification Department at HQS New Delhi is the policy making department which also coordinates the Systems Certification activities from the country in a uniform and impartial manner as per ISO/IEC 17021.
